1. Introduction

Golden Macadamias (Pty) Ltd is a holding company with two subsidiaries: Golden Macadamias Processing, trading as Lowveld Nut Processing (Pty) Ltd, and Nut and Dry Fruit Exchange (Pty) Ltd.

2. Company Contact Details

The directors of the company are Mr Leon de Kock (Chairman), Mr Justin Hearne (Vice Chairman), Mr Adam Wood, Mr Duncan Macgregor, Ms Anel du Toit, and Mr Ian Williams. The independent directors are Dr John Purchase and Mr Clause Lippert. The Information Officer is Mr Stefan Reynders. The company is located at Portion 280, Farm Alkmaar, Schagen, 1207, and can be reached by telephone at 013 733 5034 or by email at stefan@goldenmacadamias.com.

3. The Act

The Promotion of Access to Information Act grants a requester access to records of a private body, provided the record is required for the exercise or protection of any rights. If a public body lodges a request, the public body must be acting in the public interest.

Requests in terms of the Act shall be made in accordance with the prescribed procedures, at the rates provided. The forms and tariff are dealt with in paragraphs 6 and 7 of this manual.

Requesters are referred to the Guide in terms of Section 10, compiled by the South African Human Rights Commission, which contains information for the purposes of exercising Constitutional Rights. The Guide is available from the SAHRC at Private Bag 2700, Houghton, 2041, by telephone at +27-11-877 3600, by fax at +27-11-403 0625, or online at www.sahrc.org.za.

4. Applicable Legislation

The following legislation applies to Golden Macadamias (Pty) Ltd: the Companies Act (No 61 of 1973), Copyright Act (No 98 of 1978), Employment Equity Act (No 55 of 1998), Income Tax Act (No 95 of 1967), Labour Relations Act (No 66 of 1995), Value Added Tax Act (No 89 of 1991), Financial Advisory and Intermediary Services Act (No 37 of 2002), Basic Conditions of Employment Act (No 75 of 1997), Close Corporations Act (No 69 of 1984), Electronic Communications and Transactions Act (No 25 of 2002), Promotion of Access to Information Act (No 2 of 2000), Unemployment Insurance Act (No 30 of 1996), Occupational Health and Safety Act (No 85 of 1993), and the Skills Development Act (No 97 of 1998).

5. Schedule of Records

The company holds financial records including financial statements, financial and tax records (both company and employee), asset registers, and management accounts. These records are proprietary and any access must be requested in terms of the Promotion of Access to Information Act. They are not otherwise publicly available.

6. Form of Request

To facilitate the processing of your request, please use the prescribed form available on the website of the South African Human Rights Commission at www.sahrc.org.za, and address your request to the Head of the Company.

Please provide sufficient details to enable the company to identify the record or records requested, the requester (and if an agent is lodging the request, proof of capacity), and the form of access required. You should also include your postal address or fax number within the Republic, and indicate if you wish to be informed of the decision in any manner in addition to writing, along with the relevant particulars.

Finally, please specify the right which you are seeking to exercise or protect, together with an explanation of why the record is required to exercise or protect that right.

7. Prescribed Fees

The following applies to requests other than personal requests. A requester is required to pay the prescribed fees before a request will be processed. If the preparation of the record requested requires more than the prescribed hours (six hours), a deposit shall be paid of not more than one third of the access fee which would be payable if the request were granted.

A requester may lodge an application with a court against the tender or payment of the request fee and/or deposit. Records may be withheld until the fees have been paid. The full fee structure is available on the website of the South African Human Rights Commission at www.sahrc.org.za.
